Warranty general conditions

By opting for products of Sirea Group, which includes all its subsidiaries, you trust the group’s manufacturing quality, which meets the most demanding requirements. Sirea Group and its subsidiaries are pleased to offer a warranty service at the following conditions.

Terms of warranty of Sirea Group

Sirea Group, which includes all its subsidiaries, warrants that the products sold are in accordance with specifications or, where appropriate, to customer specifications and accepted in writing by one of its subsidiaries.

Apart from this guarantee of conformity and legal guarantees, equipment is warranted for any hidden manufacturing defect or material defect affecting them for twelve (12) months (or 1000 hours for the power generators), excluding the power generators from Asia which are warranty six (6) months or 300 hours, from the date of purchase. This warranty is limited, at Sirea Group decision, either to replacement or to repair of the defective or non-compliant product, excluding any other remedy.

The warranty does not apply to wear and spare parts or to normal wear-and-tear of the product, and does not cover esthetic finishing touches related to the installation.

Sirea Group do admit claims for non-compliance on the part of the customer, only if they are made in writing within 30 days following the date of receipt of the equipment, accompanied by proof of purchase indicating the acquisition date and product references.

None of Sirea Group subsidiaries can be attributed to operating loss of exploitation, production, profit or any commercial damage or loss of earnings during the period of repair or replacement of defective or non-conforming products.
The warranty applies only to products or systems design and provided by Sirea Group which includes all its subsidiaries, and in no case to any other external equipment or products, including those that would be installed as a package comprising Sirea Group products.

In no event shall the exchange or repair of a product extend the warranty period for all the equipment including the repair package. Repair is made in one of the workshops of Sirea Group, being transport costs assumed by the sender.

Specific terms of warranty of Sirea Group

Photovoltaic modules

In case of photovoltaic modules including specific conditions, warranty general conditions of manufacturers of PV modules are applied and prevail over all other terms and conditions, including the warranty general conditions of Sirea Group. The application of the warranty will be applied by manufacturers and according to the manufacturers’ conditions. Conditions are specified and subdivide as follows:

Manufacturers’ minimum product warranty

Third-party products sold by any of the subsidiaries of Sirea Group are guaranteed free from defects in material or workmanship for a period of 5 years. Additional guarantees may be agreed by Sirea Group, in writing only under certain conditions. If the product becomes defective during the period of 5 years from the purchase date or within the period agreed by any of the subsidiaries of Sirea Group, Sirea Group may, at its discretion and after acceptance of the manufacturer, repair or replace or refund the customer at market price the product.

Manufacturers warranty the following aspects :

  • The product is free from defects of mechanical nature which could affect the module stability
  • The glass presents no opacification or coloring
  • The aluminum frame will not peel off under the effect of weather within the resistance limit mentioned in the product datasheet.

The warranty will be applied subjected to a proper assembly carried out by a specialist, to normal use, and to a suitable installation of wiring and cards with no contact with water.

Damage resulting from rubbing on a rough surface, an insufficiently protected pathway, sharp edges or cutting edges, or action of animals will be excluded from this warranty.

In case of glass breakage, warranty will only be taken into account to the extent that the absence of external factors is proven.
Product appearance (scratches, stains, normal mechanical wear, corrosion, mold, optical alterations and other minor defects) does not constitute a defect since the change does not lead to a limitation of the operation of the product.

Warranty claims shall be done in writing and, after acceptance by Sirea Group, which includes any of its subsidiaries, the defective product will be returned to Sirea Group or an address to be indicated to the customer, at the customer costs, unless specifically approved in writing by Sirea Group.

Manufacturers’ minimum performance warranty

Product effective performance is ensured to be at least 80% of the nominal power, as specified on the product original label, at the end of the 25th year of use, and at least 90% of the nominal power as specified on the product original label at the end of the 10th year of use.

The request for a warranty claim assumes that the client informs Sirea Group or the manufacturer in writing about the discrepancy, accompanied by proof of purchase of the product stating the date of acquisition.
The measurement of the critical power and performance is conducted by an accredited measurement laboratory recognized by the manufacturer, according to the IEC60904 standard and is intended to take account of system measurement errors in accordance with the EN50380 standard.

In case of divergence between the measured power of the product and the threshold values previously mentioned, being the drop caused by a hardware fault or workmanship under normal installation conditions, use and maintenance, the manufacturer may, at its discretion, provide replacement products or repair the defective product at its cost, to compensate the mentioned drop and reach the production performance values above mentioned.

The performance warranty only represents a special benefit decided freely by the manufacturer of the product, who is only required to provide the service described above. Any liability beyond the limits of this duty is excluded, in particular any right to claim for damages which have not been caused by the product.

Warranty can only be granted to the extent that the product is installed, used and operated under good conditions and following the recommendations of the manufacturer or of any of the subsidiaries composing Sirea Group. Warranty benefit will be excluded in the following cases:

  • Failure to respect the assembly instructions, operation, use and maintenance of the product.
  • Exchange, modification or repair of the product carried out by the customer or third party
  • Vandalism, destruction, force majeure, flood, fire, lightning or any other external event or fact
  • Overvoltage or malfunction of components of the system not supplied Sirea Group
  • Installation in an environment unsuitable for the product, such as a marine environment or in contact with corrosive agents, or on mobile units.
  • Removal, alteration or deletion of the original product label

Unless specifically mentioned in writing by Sirea Group, the warranty starting date for the photovoltaic modules corresponds to the date of invoice. The warranty period may not be extended even in case of repair or exchange of the product.
Warranty does not include transport costs for the return or replacement of new or repaired product, or installation costs or exchange on site, unless specifically approved in writing Sirea Group. The warranty claim must be received within the applicable warranty period.

Specific warranty (product and performance) for photovoltaic modules as described above automatically ceases:
on the termination of the supplier’s activity for any reason whatsoever
on the termination of the contractual relationship between the manufacturer and Sirea Group.

Batteries

In case of batteries including specific conditions, warranty general conditions of battery manufacturers are applied and prevail over all other terms and conditions, including the warranty general conditions of Sirea Group. The application of the warranty will be applied by manufacturers and according to the manufacturers’ conditions. The name of the manufacturer and their warranty general conditions will be provided to Sirea Group customers on request.

Installation and use of batteries are made following specific recommendations particular to manufacturers. These must be strictly followed to ensure proper operation of the products.

Warranty applies only to specifications mentioned in the manufacturer’s technical documentation or provided by Sirea Group. All other warranties are excluded.

Warranty benefits will be excluded in case of non-compliance with the installation and operation procedures of the manufacturer, dismantling, even partially, of the product, non-compliance with the handling procedures, poor system design incorporating batteries, non-compliance with the product electrical data (setting in parallel and in series of battery cells) and system limitations.

Limitation and exclusion of warranties of Sirea Group

Warranties of Sirea Group do not cover damage due to:

  • Damage caused by overvoltage or radiations, regardless of their origin, excessive moisture or corrosive substances,
  • Maintenance defects or neglect,
  • Abnormal use of devices (handling or use not in accordance with manufacturer’s specifications).
  • Installation not in accordance with the recommendations of Sirea Group, nor with the rules of art
  • Intervention on the product carried out without authorization by the customer or user
  • Vandalism, destruction, force majeure, flood, fire, lightning or any other external event or fact
  • The warranty ceases if the client changes the delivered material without the consent of Sirea Group, or if repair or intervention of any person from outside an authorized workshop is confirmed.
  • In any case, the seller can not be held responsible for the direct or indirect consequences, on both for people or goods, of a failure of a service sold by him. No indemnity of any kind may be claimed because of this, including deprivation of use.
  • Unless specifically mentioned in writing by Sirea Group, the warranty starting date for the product corresponds to the date of invoice.
  • Warranty, including specific conditions, is exclusively applied to the original customer of Sirea Group.

Applicable law – Jurisdiction

Warranty benefits granted on the basis of this document are exclusively governed by French law. Any litigation regarding the warranty benefits will be the sole jurisdiction of French courts.
